Is Obama?s promise of US troops in the Sinai an outright lie?

Is the Gaza cease fire agreed to by Benjamin Netanyahu based on a lie told the PM by Barack Obama?

Egypt?s president Mohamed Morsi should be forever beholding to Barack Hussein Obama. After all, Obama?s calculated ouster of former Egyptian president Hosni Mubarek gave Morsi the job of ruling the Middle East?s most populous nation. And ruling is the right word as Morsi has granted himself both dictatorial power and immunity from prosecution by Egypt?s courts.

I ?may take the necessary actions and measures to protect the country and the goals of the revolution,? writes the Egyptian president in Article 6 of his power grab decree. Morsi also becomes the ?Sovereign of the State? who can ?claim exception against all rules.? ?(There exists a similar situation in the United States, though it has yet to be put in writing.) (1)

Fortunately, no one in Egypt needs worry about the true intentions of their self-appointed pharaoh. After all, Morsi has assured Egyptians that his new dictatorship is only a temporary state of affairs ?until a new constitution can be drafted and a new parliament elected.?? As a dedicated member of the Muslim Brotherhood, surely he can be taken at his word!

But upon release of his decree on Egyptian television, protests and rioting began throughout the nation. For although Morsi won the ?democratically held? election earlier this year, even the massive voter fraud reportedly engineered by the Muslim Brotherhood could only provide the new president a very narrow margin of victory over the competition.

So why would Morsi agree to the placement of United States soldiers in Egypt?s Sinai region? After all he?ll win few Egyptian friends by inviting American troops into the country and certainly none among his Muslim Brotherhood peers. Yet according to Israel?s Debka, during a conversation with P.M. Benjamin Netanyahu, ?Barack Obama personally pledged to start deploying US troops in the Egyptian Sinai next week,? that is, yesterday or today!? And Obama obviously needed Morsi?s permission to do so. In fact it was only this promise which convinced Netanyahu to accept the cease fire as Obama guaranteed American soldiers would halt the smuggling of arms through Sinai to Hamas in Gaza. (2)

But did Obama lie to Netanyahu? According to Egypt?s Daily News ?there is no truth to what has been published on Israeli websites on plans for the deployment of US troops in the Sinai as part of the ceasefire agreement in Gaza between Hamas and Israel.? Is this statement by the Egyptian armed forces true? Did Netanyahu lie about what he was told by Obama? (3)

Clearly, something is going on here. Debka is not the sort of news provider to make up a story, least of all one of such import. Would Obama lie? That question answers itself. But what would he hope to gain unless it be time for Hamas to replenish its stock of weapons through the usual smuggling routes in the Sinai?? Naturally this would necessitate a prior agreement between Obama and Morsi, indicating the sort of intrigue and betrayal of which both are certainly capable.

This will be a very interesting story to watch during the coming days. For it?s a safe bet that Barack Obama is more concerned with keeping Mohamed Morsi?s friendship and cooperation than Benjamin Netanyahu?s!

Can Reality TV Boost Self-Control?Flipping through one of Psychology Today?s recent issues, my eyes focused on a short article ?Just Give In. Five Indulgences that actually boost self-control? by Kelly McGonigal, Ph.D.

What are these five indulgences? Personally, I was hoping chocolate was on the list. (Unfortunately, it?s not!) McGonigal narrows it down to these five things: a single espresso, an afternoon nap, a snack, YouTube and reality television.

The author writes that ?Willpower diminishes as the day wears on, but anything that reduces stress, boosts your mood, or recharges your energy can also reboot your self-control.?

Even ?reality TV??

Last night, after watching various contestants on a popular reality show sing for 90 minutes, I felt like falling asleep. Willpower? I must be watching the wrong program. Survivor might give me some energy: watching people trudge through swamps and sleep in tents, screaming at each other and falling in ?love? the next episode.

I kept reading, hopeful that the small paragraph devoted to the indulgence of reality television would explain our culture?s obsession with watching other people. People on a screen and not, say, upstairs in a different room or a phone call away.

?Willpower is contagious,? the author continues. ?Many reality shows feature people working hard to overcome obstacles as they lose weight, face their fears, or organize their clutter.?

I paused reading and recalled a past co-worker who spent, unfortunately, at least 30 minutes every single day talking about her favorite show, The Biggest Loser. We worked side-by-side and so this was particularly irritating, but even more so was the fact that she spent time talking to me ? and anyone else who would listen ? about her diets. She had a new diet every week and none of them worked.

I guess the show?s ?willpower? did not translate to her lifestyle. Sort of like how I can?t sing a note despite watching all of these silly singing shows.

The article concludes with ?You can ?catch? extra self-control just by watching someone pursue a goal.? Hmm. While the author of this article believes that television can boost willpower and productivity, I disagree. Watching television is a sedentary activity and it uses very few brain cells ? feeding your dog uses more. [Ed. - Although it may be a common popular perception, there's also little research that supports the idea that reality TV shows can help a person with their own willpower or act as a personal motivator.]

So, what?s the verdict? The reality is that watching reality television is a form of escape. I doubt it promotes ?self-control? (am I the only one who eats dinner while watching television?) but it has ingrained its way into our culture.

That aside, watching the presidential debates far exceeds the drama I have witnessed in any episode of Survivor. In the end, ?real life? is reality.

#sci4hels - the `killer' science journalists of the future want your feedback

If you are a really regular, diligent reader of this blog, you may remember back in September when I announced a panel I have organized for the next year?s WCSJ2013. The eighth World Conference of Science Journalists, organized by World Federation of Science Journalists will be held in Helsinki, Finland on June 24-28th, 2013, and in that post I explained in great detail what the panel will be all about, what was my initial motivation for proposing that panel, and the systematic method I used to pick, out of dozens and dozens of excellent potential candidates, the four people who will travel to Finland and dazzle everyone there.

The ?killer? science journalists of the future

The science media ecosystem has never been as big, as good or as vibrant as it is today. Many young writers are joining the ranks of veterans each year ? and they are good! Many of them have science backgrounds. They all write really well. And they are digital natives, effortlessly navigating today?s online world and using all the tools available to them. But some of them are going beyond being well adapted to the new media ecosystem ? they are actively creating it. They experiment with new forms and formats to tell stories online, and if the appropriate tool is missing ? they build it themselves. Not only can they write well, they can also code, design for the web, produce all types of multimedia, and do all of this with seemingly more fun than effort, seeing each other as collaborators rather than competitors. I?d like to see the best of them tell us what they do, how they do it, and what they envision for the media ecosystem they are currently building.

The panel will explore skills and attitudes needed to succeed in the emerging science media ecosystem and in building that ecosystem to be even better, more efficient, and having a broader reach. It will explore how to make the world better both for science journalism and for science journalists. We will explore what skills and attitudes are important for new, up-and-coming science writers to become successful and to help bring in a better science media world into being.

Different people have different goals. Some will be hired as staff writers or editors in specialized science media organizations, others in general-purpose media organizations, be it online, print, radio, television, or other types of media. Some will pool resources with friends and start new media organizations. Some want to become successful Public Information Officers for universities, institutes, companies, organizations of governmental entities. Others want to become successful as freelance writers. And yet others may want to become respected, popular science bloggers while keeping their other daytime jobs.

We will explore issues related to necessary technical skills, attitudes toward tasteful self-promotion, required levels and types of expertise, and more, both as advice to individuals, and as advice to science writing programs and journalism schools on how to upgrade their teaching philosophies to adapt to the 21st century.

The panelists are not waiting till June, though. They have already started, and will use the next seven or so months to discuss all of these issues in various ways. It?s not just what they will say during the 60 minutes of the panel, but also how they will do it ? show, not tell. This will not be a traditional series of droning talks with dreaded PowerPoints. As veterans of ScienceOnline conferences, they know how to make a panel dynamic, interactive and exciting. The panel itself is not all, it will be just the final highlight of months of discussion, and hopefully the discussions will continue after the panel as well, provoked by the panel.

The website will be active, continuously adding resources, tools, important links (including to the blog posts by all of us and reactions by others), and hoping to foster discussions of the topic. MEMORANDUM DECISION AND ORDER

INTRODUCTION

While skiing at Alta ski area, Plaintiff Laura Jozewicz (?Jozewicz?) fell and injured her neck. Jozewicz contends she fell because the binding on her skis unexpectedly released due to a product defect. Jozewicz rented the skis from Defendant GGT Enterprises, LLC (?GGT?). At the time of rental, a recall notice was in effect for the binding, but GGT did not remove the product from its rental inventory. Nevertheless, GGT seeks dismissal of Jozewicz?s negligence claim on the basis that she signed a release from liability at the time she rented [*2] the skis. For the reasons discussed below, the court denies GGT?s motion to dismiss.

FACTUAL BACKGROUND

On March 17, 2008, GGT rented skis to Jozewicz. On March 18, 2008, Jozewicz fell and injured her neck while skiing at Alta ski area. Jozewicz claims her fall occurred when the Marker MI Demo binding on her rental ski released unexpectedly. Jozewicz alleges that Defendants K2 Corporation and Jarden Corporation (collectively ?K2/Jarden?) manufactured the ski binding. Prior to Jozewicz?s fall, K2/Jarden notified the United States Consumer Product Safety Commission (?Commission?) regarding the binding, and the Commission subsequently issued a recall alert on May 30, 2007, due to ?Unexpected Release, Fall Hazard.? 1 The recall alert stated that ?[s]ki shops with these bindings in their rental inventory should not rent this equipment to consumers until it has been upgraded.? 2 The recall further stated that ?[s]kiers can unitentionally displace a lever at the rear of the binding,? which ?[i]f it is fully displaced, . . . can result in the unexpected release of the binding and possibly cause the user to fall.? 3

Prior to renting her [*3] skis from GGT, Jozewicz signed an ?Equipment Rental and Liability Release Agreement,? which states in relevant part:

I understand that the binding system cannot guarantee the user?s safety. In downhill skiing, the binding systems will not release at all times or under all circumstances where release may prevent injury or death, nor is it possible to predict every situation in which it will release. . . .

I understand that the sports of skiing, snowboarding, skiboarding, snowshoeing and other sports (collectively ?RECREATIONAL SNOW SPORTS?) involve inherent risks of INJURY and DEATH. I voluntarily agree to expressly assume all risks of injury or death that may result from these RECREATIONAL SNOW SPORTS, or which relate in any way to the use of this equipment. . . .

I AGREE TO RELEASE AND HOLD HARMLESS the equipment rental facility, its employees, owner, affiliates, agents, officers, directors and the equipment manufacturers and distributors and their successors in interest (collectively ?PROVIDERS?), from all liability for injury, death, property loss and damage which results from the equipment user?s participation in the RECREATIONAL SNOW SPORTS for which the equipment is provided, or [*4] which is related in any way to the use of this equipment, including all liability which results from the NEGLIGENCE of PROVIDERS, or any other person or cause.

I further agree to defend and indemnify PROVIDERS for any loss or damage, including any that results from claims or lawsuits for personal injury, death, and property loss and damage related in any way to the use of this equipment. 4

GGT claims the release agreement bars Jozewicz?s negligence claim.

ANALYSIS

I. STANDARD FOR REVIEW

Defendant GGT brings this motion under Federal Rule of Civil Procedure 12(b)(6). When considering a 12(b)(6) motion, ?a court must accept as true all well-pleaded facts, as distinguished from conclusory allegations, and those facts must be viewed in the light most favorable to the nonmoving party.? 5 The complaint must include ?enough facts to state a claim to relief that is plausible on its face.? 6 ?The court?s function on a Rule 12(b)(6) motion is not to weigh potential evidence that the parties might present at trial, but to assess whether the plaintiff?s complaint alone is legally sufficient to state a claim [*5] for which relief may be granted.? 7 Consequently, a court does not look at evidence outside of a pleading to determine such motions. 8 If a court does rely ?on material from outside the pleadings, the court converts the motion to dismiss into a motion for summary judgment.? 9 Because the court relies on material outside of the pleadings in this case, the court converts this motion into a motion for summary judgment.

A. Limitations on Preinjury Releases

Without question, individuals ?may contract away their rights to recover in tort for damages caused by the ordinary negligence of others.? 10 The Utah Supreme Court has recognized, however, ?that preinjury releases are not unlimited in power and can be invalidated in certain circumstances,? including when (1) the release offends public policy, (2) the release is for activities [*6] that fit within the public interest exception, or (3) the release is unclear or ambiguous. 11 The second limitation is not at issue here because ?preinjury releases for recreational activities,? such as skiing, ?cannot be invalidated under the public interest exception.? 12 Likewise, the third limitation is not at issue because Jozewicz conceded during oral argument that the release is not unclear or ambiguous. Thus, the prevailing issue in this case is whether a public policy concern overwhelms the effect of the preinjury release that Jozewicz signed.

B. Public Policy Considerations

Preinjury releases must be compatible with public policy to be enforceable. 13 Previously, the Utah Supreme Court has invalidated preinjury releases when they were contrary to public policy set forth in statutory provisions. The court has recognized that ?[w]hen . . . the Legislature clearly articulates public policy, and the implications of that public policy are unmistakable, we have the duty to honor those expressions of policy in our rulings.? 14 Thus, in Hawkins v. Peart, the [*7] Utah Supreme Court held that public policy invalidated a preinjury release signed by a parent on behalf of a minor child. 15 The court looked to Utah statute and found that it ?provides various checks on parental authority to ensure a child?s interests are protected.? 16 In particular, it found that when a child is injured, statutory law precludes a parent from settling a claim, unless the parent is appointed as conservator for the child. 17 Based on this clear legislative intent to protect a minor?s interest post injury, the court concluded that a preinjury release for a minor child likewise was unenforceable. 18

As applicable to this case, Congress has expressed its concern about product defects that pose a significant risk of injury or death. In an effort to protect the public from such defects, it enacted the Consumer Product Safety Act (the ?Act?). The stated purpose of the Act is:

(1) to protect the public against unreasonable [*8] risks of injury associated with consumer products; (2) to assist consumers in evaluating the comparative safety of consumer products; (3) to develop uniform safety standards for consumer products and to minimize conflicting State and local regulations; and (4) to promote research and investigation into the causes and prevention of product-related deaths, illnesses, and injuries. 19

Through this legislation, Congress has stated its intent to create laws that protect the public from unreasonable risk of harm from defective products and to provide a uniform regulatory scheme to promote product safety.

Under 15 U.S.C. ? 2064(b), manufacturers, distributors, and retailers are required to notify the United States Consumer Product Safety Commission when they become aware a product (1) fails to comply with applicable safety standards, (2) fails to comply with other rules, regulations, standards, or bans under any acts enforced by the Commission, (3) ?contains a defect which could create a substantial product hazard,? or (4) ?creates unreasonable risk of serious injury or death.? 20 Recall alerts arising from such notices are specifically designed to prevent serious [*9] injuries. Under 15 U.S.C. ? 2068, manufacturers and distributors are charged with honoring the recall alerts issued by the Commission. The law in effect at the time of Jozewicz?s accident stated:

It shall be unlawful for any person to ?

(1) manufacture for sale, offer for sale, distribute in commerce, or import into the United States any consumer product which is not in conformity with an applicable consumer product safety standard under this chapter;

(2) manufacture for sale, offer for sale, distribute in commerce, or import into the United States any consumer product which has been declared a banned hazardous product by a rule under this chapter. 21

Congress enacted the statute to ensure [*10] safe products are provided to the public and to limit the risk of injury. Once a manufacturer, distributor, or retailer reports a defect to the Commission and a recall alert is published, the alert would have no effect if other retailers were not required to take action to correct the defect or remove the product from their inventory. The law requires distributors and retailers to heed recall alerts issued by the Commission and ensure defective products are either fixed or not sold.

Jozewicz argues that Congress?s public policy concern to prevent unreasonable risk of serious injury or death to the public meets the public policy standard set forth by the Utah Supreme Court, and therefore invalidates her release of GGT?s negligence. GGT contends, however, that Congress did not intend for the Consumer Product Safety Act to preempt state law, and no private cause of action exists under 15 U.S.C. ? 2064(b). While this is true, this does not nullify the stated public policy concerns that override the right of parties to contract away tort liability. The rental of the ski bindings at issue in this case became unlawful once the recall notice became effective. Public policy should not favor [*11] allowing a party to insulate itself from harms caused to others arising from unlawful acts. Moreover, a decision that public policy causes a preinjury release to be invalid in this case does not cause GGT to be held liable under the Act, nor does it preempt state law. It merely recognizes Congress?s concern to minimize unreasonable risk to the public of serious injury or death. Such a concern is particularly relevant when a latent defect exists of which distributors and retailers are or should be aware, but not a consumer.

The implication of allowing distributors and retailers to contract away liability for noncompliance with established safety standards would increase the risk of injury and would be contrary to Congress?s express public policy concerns. Furthermore, validating the release of liability for noncompliance with Federal law would effectively reduce or eliminate the responsibility that distributors and retailers have to make sure the products they sell or rent are safe. Public policy should encourage compliance with safety laws, not disregard for such laws. Due to a strong public interest in ensuring adherence to recall alerts, the court concludes that GGT?s release is unenforceable [*12] as a matter of public policy.

CONCLUSION

GGT?s preinjury release is unenforceable and invalid as a matter of public policy. For this reason, GGT?s motion is DENIED. 22

While the Bills and Colts battled it out on the field, cheerleaders Megan M and Crystal Ann had their heads shaved on the sideline in an effort to support cancer awareness and research. It was a beautiful moment, and all for a worthy, noble cause.

Cheerleaders exist on a football field to promote glamor, beauty, and fun. Their looks are everything, and many of us associate beauty with long, flowing hair. For two of them to shave that hair off was spectacular on their parts.

The campaign to shave Megan and Crystal Ann's heads was part of #OperationShaveMegansHead, all set-up by the Colts and their mascot, Blue. Megan was the only cheerleader slated to get buzz cut on Sunday, but Crystal Ann decided to join her in solidarity.

The campaign reportedly raised $ $22,670 over the past two weeks. The goal was to earn $10,000 for leukemia by November 25th. Mission accomplished. Bravo Megan and Crystal Ann.

Science fund cuts could hurt EU recovery, scientists warn

LONDON (Reuters) - Cutting science funding in the European Union would threaten economic recovery in the bloc, the heads of scientific organisations said on Friday after such cuts were proposed.

"We believe it would be deeply damaging to future economic growth if we were to cut funding now," Andrew Harrison, director general of Grenoble-based neutron research centre the Institut Laue-Langevin, told Reuters.

EU leaders on Friday abandoned talks to find a deal on the bloc's budget for 2014-2020 but European Council President Herman Van Rompuy, who chaired the summit, proposed cuts in a number of areas, including research and innovation, in an effort to reach a deal.

According to a document seen by Reuters, Van Rompuy's proposal penciled in a 139.5 billion euro ($180.8 billion) budget under the competitiveness-for-growth heading, which includes the EU's flagship Horizon 2020 research funding programme.

This is a further cut from a Van Rompuy proposal earlier this week of 152 billion euros and down sharply from an original Commission proposal of 164 billion euros.

Although it is unclear if there would be any knock-on effect from the proposed cuts on Horizon 2020 when talks resume early next year, the original budget for the research programme was 80 billion euros, roughly half the original pot.

European scientists, whose funding is already under pressure from the economic downturn, will be alarmed at the prospect of cuts to one of the biggest science budgets in the world.

Harrison, of the Grenoble-based research centre, joined in a lobbying effort with seven other world-leading research organisations calling on the Commission to defend science funding ahead of the budget summit.

In a letter to Commission President Jose-Manuel Barroso that was also signed by Rolf Heuer, director general of the CERN research centre near Geneva, the organisations warned that science should be central to Europe's long-term prosperity.

"At a time when a return to growth is the most pressing policy priority across Europe, it is absolutely vital that investment in our scientific resources (both human and technical) is sustained," they said.

The signatories also included Iain Mattaj, head of the European Molecular Biology Laboratory; Alvaro Gimenez Canete, director of science and robotic exploration at the European Space Agency and Tim de Zeeuw, head of the European Southern Observatory (ESO).

"We are all world leading in our fields," said Harrison. "We are cautioning very strongly against cuts now."

LONG-TERM BENEFITS

Harrison said that although researchers needed to do a better job in demonstrating the economic value of research, there was no doubt about the long-term benefits of investment in science.

"Europe is not going to compete in the mass labour market or in natural resources, we are only going to compete because we are smarter," he said. "Right now I'm not fantastically confident."

Van Rompuy's proposal earmarked nearly 13 billion euros for specific projects, including Galileo, the European replacement for the Global Positioning System satellite network, and the ITER nuclear fusion research project.

But Horizon 2020 will be the mainstay of EU research grants and the implications for the funding programme remain unclear.

"Science isn't going to die if they don't implement Horizon 2020 fully," said Bruno Leibundgut, director for science at ESO. "But these countries are going to suffer from this five or 10 years down the line."

McIlroy four-putted the final green on Friday to crash out of the event by three shots - the second time this year the 23-year-old has had to sit out the weekend rounds as defending champion after also missing the cut in June's US Open in San Francisco.

Before leaving Hong Kong for Dubai and the season-ending World Tour Championship, McIlroy said he will spend coming weeks working out where he will compete in 2013.

"Of course, you're going to miss cuts in your career, but it's not nice and it's a tough pill to swallow when you're the defending champion in a tournament," the Northern Irishman said.

"While there's a part of me that perhaps wished my year had ended as soon as I wrapped up the Race to Dubai, I now look back over the last couple of years wondering why did I stretch myself so much," he added. "I've probably played an extra couple of tournaments too much and I have learnt from the last few years, so that's why I'm cutting back my schedule even further from next year."

Counting next week's European Tour closing event, McIlroy will have contested 24 tournaments this season as well as the Ryder Cup and two exhibition events.

McIlroy arrived in Hong Kong sounding tired after wrapping up the Race to Dubai money title a week earlier with his third-placed finish at the Singapore Open.

"I'm not sure if the energy in trying to sew up the Race to Dubai and competing in the FedEx Cup has taken more out of me than maybe I thought because, while I am feeling OK physically, mentally I feel really tired," he said.

"When you achieve something that you want to achieve so bad, like the Race to Dubai, there is a letdown considering there are still two events remaining."

Last year, McIlroy competed in 22 regular European and PGA Tour events, but also contested the Grand Slam of Golf, the World Cup, the Korean Open and the China Golf Challenge.

After combined European and PGA Tour earnings this year of $US9.62 million ($A9.35 million), McIlroy will bank another $US1 million ($A973,000) by just teeing up in Dubai - the "bonus pool" first prize for capturing the Race to Dubai.

Dyle Brings Legal, Live TV To Your iPad, With Many Strings ...

Want to watch live TV on your iPad? You don?t have many options.

A handful of networks, including Disney and ESPN, will stream shows to your tablet, but you?ll need a cable subscription to make them work.

And if you live in New York City, Aereo will let you watch programming from broadcast networks. But since it isn?t paying the networks for that programming, the networks are suing to shut Aereo down.

So here?s another choice: Dyle, which launches for Apple?s iOS devices today. You?re probably not going to love it.

Dyle is backed by a consortium that includes NBC, Fox* and a lot of broadcast station owners, and it does have some things going for it:

  • Dyle is free, for now.
  • Dyle doesn?t require Wi-Fi or wireless service, because it?s beamed over the same airwaves the TV stations (still) use to send signals to TV sets. That means you can watch all you want, without worrying about data caps or charges.
  • Since Dyle is backed by (some) of the networks and TV stations, there?s no legal grey area: It?s 100 percent legit.

On the other hand:

  • You?ll need a $100 adapter ? basically a combination antenna and battery ? in order to use Dyle on Apple devices.
  • Dyle only provides you with a handful of programming choices in the 35 cities it operates in ? basically, whatever?s on most NBC and Fox stations, and a smattering of other channels.
  • Dyle doesn?t offer any DVR functions, which means you have to watch in real time, or not at all. And you can?t fast-forward through commercials.
  • One of live TV?s biggest selling points is sports. But a rights blackout means you can?t watch NFL games on Dyle. (That?s the only programming hole, though: An earlier version of the service did let users watch the NBC?s Olympics broadcast, and Fox?s World Series games this year.)
  • If you?re the kind of person who doesn?t want to buy an iPad mini because it doesn?t have Retina display, you?re not going to want to come near Dyle, which doesn?t broadcast in anything like HD. The picture looks okay on an iPhone, but by the time the image gets blown up to an iPad-size screen, it?s quite grainy.
  • Dyle?s backers can?t promise that the service will remain free after the end of this year. It probably will. But, for whatever reason, they won?t say that out loud.

That?s a lot of hurdles to put in place of a consumer pondering a purchase. So why is Dyle bothering at all?

Dyle?s backers won?t come out and put it this way, but this appears to be a proof-of-concept test instead of a full-fledged product launch (Dyle has already been on the market for a few months, via MetroPCS?s?Samsung Galaxy S Lightray 4G, which comes with a preinstalled app and a built-in antenna).

You can imagine a future where Dyle would make more sense: It would offer TV from all the broadcasters, and the hardware it needs would get built directly into the gadgets themselves; it would also offer features like recording capabilities.

And at that point the Dyle guys could play around with different business models: They could charge a monthly fee for service. Or bundle it for ?free? with a cable TV subscription.

But in order to get to that point, the Dyle guys need to prove that there?s demand for what they?re already offering. It?s a tough chicken-and-egg problem, but you can at least give them credit for trying.

Senate, House resolutions back Israel?s actions in Gaza

WASHINGTON (JTA) -- Both Houses of the U.S. Congress unanimously passed resolutions expressing support for Israel's "inherent right to act in self-defense."

The identical non-binding resolutions passed Thursday in the Senate and Friday in the U.S. House of Representatives,

Initiated in the Senate by Sens. Kirsten Gillibrand (D-N.Y.) and Mark Kirk (R-Ill.) and Reps. Ileana Ros-Lehtinen (R-Fla.) and Howard Berman (D-Calif.) in the House, each resolution "expresses unwavering commitment to the security of the State of Israel as a Jewish and democratic state with secure borders, and recognizes and strongly supports its inherent right to act in self-defense to protect its citizens against acts of terrorism."

By Thursday evening, the Senate resolution had garnered 64 cosponsors.

The American Israel Public Affairs Committee in a statement praised "the leadership of Senators Gillibrand and Kirk, and the extraordinary show of support by the Senate for Israel?s struggle against terrorist attacks on its citizens."

The resolutions are the first such proposed legislation in the wake of Israeli airstrikes launched Wednesday in retaliation for rocket attacks from the Gaza Strip

Unlike statements of support for Israel's actions from the Obama administration, the resolutions do not call on both sides to exercise restraint or express regret at casualties on both sides.

"We strongly condemn the barrage of rocket fire from Gaza into Israel, and we regret the death and injury of innocent Israeli and Palestinian civilians caused by the ensuing violence," Jay Carney, the White House spokesman, told reporters on Thursday.?"There is no justification for the violence that Hamas and other terrorist organizations are employing against the people of Israel.?We call on those responsible to stop these cowardly acts immediately in order to allow the situation to de-escalate."

Twenty-eight Palestinians, including at least two children, and three Israelis have been killed in the escalated violence between Israel and Palestinian terrorists. Among the dead Palestinians is a terrorist leader, Ahmed Jabari.

A host of lawmakers have issued statements in support of Israel, and Israeli Ambassador Michael Oren on Wednesday briefed five senators from both parties -- Sens. Barbara Boxer (D-Calif.), Bob Casey (D-Pa.), Jeanne Shaheen (D-N.H.), Jim DeMint (R-S.C.) and Johnny Isakson (R-Ga.).

"As a bipartisan group of Senators committed to Israel's security, we express our solidarity with Israel during this deeply challenging period and denounce the reprehensible and indiscriminate rocket attacks launched by Hamas and Islamic Jihad against innocent Israeli citizens," the senators said in a joint statement.

AIPAC praised the outpouring of congressional support.

"These statements demonstrate?that America continues to firmly stand with Israel and her right to defend herself," it said. "No nation can tolerate constant barrages of rockets against?its civilian population."

Apple grows war chest, takes ownership of 1,024 Nortel patents

Apple has reportedly received a transfer of 1,024 patents or patent applications from Rockstar Consortium, formerly Rockstar Bidco, a group of technology companies that bid on thousands of patents that had previously held by Nortel. Apple had been part of Rockstar Bidco, which bid against Google for the patents, and had access to the patents through that consortium. The transfer of patents to Apple?s ownership, however, could better position them in ongoing litigation. Owen Thomas of Business Insider reports:

Apple already had access to these patents, since it owns a large stake in Rockstar Consortium. That venture, formerly known as Rockstar Bidco, bid $4.5 billion, of which Apple provided $2.6 billion, on a collection of 4,000 patents sold by Nortel. Microsoft, Sony, Ericsson, and RIM also backed Rockstar, which beat out Google in the bidding for the patent collection.

Even as Apple has settled with HTC and may be prepared to settle at least part of their case against Motorola Mobility, and won $1 billion verdict against Samsung in the U.S., a number of other, international cases, haven't gone Apple's way.

So, while the contents of these patents is unknown, except that they deal primarily with mobile technology, they could help solidify Apple's current and future litigation.

With Samsung is reportedly unwilling to settle at this point, having already reaped the rewards of what Apple considers their "copyist" behavior, perhaps Nortel's patents could help change their minds?

It?s possible that, with the acquisition of these patents, Apple will have enough leverage to get Samsung to settle at least some of the outstanding lawsuits between the companies, and the mobile world can enjoy even a little bit of rest after a long, drawn-out patent conflict.

(AP) ? Japanese Prime Minister Yoshihiko Noda dissolved the lower house of parliament Friday, paving the way for elections in which his ruling party will likely give way to a weak coalition government divided over how to solve the nation's myriad problems.

Elections are set for Dec. 16. If Noda's center-left party loses, the economically sputtering country will get its seventh prime minister in six and a half years.

The opposition Liberal Democratic Party, which led Japan for most of the post-World War II era, is in the best position to take over. The timing of the election likely pre-empts moves by more conservative challengers, including former Tokyo Gov. Shintaro Ishihara, to build electoral support.

Campaigning is set to begin Dec. 4, but leaders were already switching into campaign mode.

"What's at stake in the upcoming elections is whether Japan's future is going to move forward or backward," Noda declared to fellow leaders of the Democratic Party of Japan. "It is going to be a crucial election to determine the fate of Japan."

The DPJ, in power for three years, has grown unpopular largely because of its handling of the Fukushima nuclear crisis and its recent doubling of the sales tax.

Noda's most likely successor is LDP head and former Prime Minister Shinzo Abe. He resigned as Japan's leader in 2007 after a year in office, citing health problems he says are no longer an issue.

"I will do my utmost to end the political chaos and stalled economy," Abe told reporters. "I will take the lead to make that happen."

The path to elections was laid suddenly Wednesday during a debate between Abe and Noda. Noda abruptly said he would dissolve parliament if the opposition would agree to key reforms, including a deficit financing bill and electoral reforms, and Abe jumped at the chance.

Polls indicate that the conservative, business-friendly LDP will win the most seats in the 480-seat lower house but will fall far short of a majority. That would force it to cobble together a coalition of parties with differing policies and priorities.

"It's unlikely that the election will result in a clear mandate for anybody," said Koichi Nakano, a political science professor at Sophia University. "So in that sense, there's still going to be a lot of muddling through."

The election, and the divided government that is likely to follow, complicate efforts to extricate Japan from its two-decade economic slump and effectively handle the cleanup from its 2011 nuclear disaster.

Still, many saw the prospect of change as positive: Japan's Nikkei 225 stock index jumped 2.2 percent Friday to 9,024.16.

Japan's leaders urgently need to devise strategies for coping with a soaring national debt, now more than double the national GDP, and a rapidly aging population. Japan must also decide whether it will follow through with plans to phase out nuclear power by 2040 ? a move that many in the LDP oppose.

Perhaps most pressing is Japan's festering territorial dispute with China, which has hammered Japanese exports to its biggest trading partner.

A staunch nationalist, Abe has railed against China in the dispute over a cluster of uninhabited islands in the East China Sea controlled by Japan but also claimed by China and Taiwan.

Japan is going through a messy political transition, with a merry-go-round of prime ministers and the emergence of various parties to challenge the long-dominant LDP.

The DPJ ousted the LDP in a 2009 landslide, raising hopes for change. But the DPJ's failure to keep campaign promises and the government's handling of the nuclear crisis triggered by a March 11, 2011, earthquake and tsunami left many disillusioned. Noda's centerpiece achievement during nearly 15 months in office was a highly unpopular bill doubling the 5 percent national sales tax by 2015.

Polls show public support for the DPJ in the low teens, while 25 to 30 percent of voters back the LDP. Several other parties have lower levels of support, and nearly half the electorate is undecided.

"There are so many lying politicians," said Tokyo resident Michiyo Komaki. "I just wish for a leader who would do his job properly."

Ishihara recently resigned as Tokyo governor to create the Sunrise Party. As governor, he helped instigate the territorial crisis with China by declaring that Tokyo would buy and develop the disputed islands controlled by Japan but long claimed by Beijing. The central government bought the islands itself, intending to thwart Ishihara's more extreme plans, but China was still enraged.

Ishihara has been courting Toru Hashimoto, the young, outspoken mayor of Osaka, Japan's second-biggest city, in hopes of tapping voter dismay. Both have formed their own national political parties, but may not have enough time to get organized for the election.

The two men are reportedly in discussions to merge their parties and form a so-called "third force" to counter the LDP and DPJ, but apparently are struggling to reconcile conflicting policy views, including on nuclear power.

"The era of one-party dominance is clearly over and behind us," said Nakano, the professor. "We know what we are transiting from, but we don't know where we are going."
