Arenas v. Shed Media U.S. Inc., 2011 WL 8427612 (C.D. Cal.) Gilbert Arenas plays basketball for the Orlando Magic.? He was previously in a relationship with a woman named Govan, with whom he has four children.? Basketball Wives, a Shed Media production on VH1, is about the lives and relationships of a group of women, ?most of whom have or have had a romantic relationship with a professional basketball player.?? Basketball Wives: Los Angeles (BWLA), a spinoff, included Govan in the cast.? The promotional materials describe her as the sister of Gloria Govan, the fianc?e of Los Angeles Lakers player Matt Barnes, and mention her children, but don?t mention Arenas.? Arenas sued for trademark infringement, trademark dilution, false advertising, and false endorsement under federal law, as well as violations of California?s common law and statutory right of publicity and violation of the UCL.? He sought a preliminary injunction against the use of any of his alleged trademarks in the show; if he appears in the show, the use of ?Basketball Wives? or any other term that would suggest affiliation with basketball players; or the use of ?any other means to suggest affiliation with basketball players, such as including more than two participants who are known to be affiliated with basketball players.?? (Comment: wow.? Basically, Arenas sounds like he?s taken instruction from the Olympics in asking that his delicate commercial sensibilities be protected from any unapproved hint that he exists!) Defendants moved to dismiss and brought a special motion to strike under the anti-SLAPP statute. Such motions are to be granted if (1) the cause of action arises from any act by the defendants in furtherance of their free speech rights under the federal or state constitution; (2) the act is ?in connection with a public issue?; and (3) the plaintiff fails to establish a probability that he will prevail on the claim. The court began with the common-law commercial misappropriation claim.? The court first asked whether the show would appropriate Arenas?s identity.? Without episodes on hand, the court could only speculate based on Shed Media?s declarations and promotional materials, which didn?t explicitly refer to Arenas.? Shed Media, however, recognizing its long-term interest in freedom to operate (that is, to speak), took the position that ?future promotional materials could certainly refer to Govan?s prior relationship with Plaintiff.?? The court found that it was likely that Govan would discuss Arenas on the show.? The court then turned to the question of whether such on-air discussions would constitute ?use? of Arenas?s identity as a celebrity, and answered in the affirmative.? The old Here?s Johnny case said that there wouldn?t be any violation of the right of publicity if a defendant?s use didn?t appropriate the celebrity?s ?identity as a celebrity,? for example the ?John William Carson Portable Toilet.?? Here, by contrast, Arenas?s name would be used in the context of a show about ?Basketball Wives,? and would refer to his status as a famous basketball player.? However, the court conceded that Govan?s inclusion on the show alone wouldn?t invoke Arenas?s identity, since she was the sister of one of the other ?wives,? and her appearance on the show was therefore ?explicable? without reference to Arenas.? (I take it then that Kato Kaelin violates OJ Simpson?s right of publicity by existing, under this analysis.)? True, the court continued, other media outlets made the connection with Arenas, but that?s only to be expected from ?an age of tabloid journalism and celebrity obsession,? when ?news outlets frequently uncover and publicize connections between celebrities.? As was widely reported in 2008, President Obama was distantly related to former V.P. Cheney.? But the court wasn?t willing to make the ?improbable? assumption that Govan would refrain from discussing her relationship with Arenas onscreen.? This would constitute appropriation of Arenas?s identity for commercial gain.? That he wasn?t the focus of the show, but rather the women were, was immaterial.? (Citing, inappositely, White, which held that it didn?t matter what aspect of the plaintiff?s identity?image, voice, etc.?the defendant appropriated; in White the song was a central element of the ad, not an incidental part, so the court is making new law?though that will soon be mostly eaten by the rest of the analysis; still, clever plaintiffs will like this statement for incidental uses.) Fortunately for Shed Media, the court found this commercial appropriation to be protected by the First Amendment both under the transformative use test and the public interest test.? Transformativeness: when the value of the work comes principally from the defendant, the First Amendment protects against liability.? But ?when an artist?s skill and talent is manifestly subordinated to the overall goal of creating a conventional portrait of a celebrity so as to commercially exploit his or her fame, then the artist?s right of free expression is outweighed by the right of publicity.? ?Saderup.? (Consider, in this regard, why a ?conventional? biography?say, an hour of television in a series of celebrity profiles, following a standardized format?wouldn?t flunk this test.? Saderup relies on dishonesty about art.? But that doesn?t matter here.)? On the current record, the court found that references to Arenas would be incidental to the show?s plot.? ?At its core, the show is about the women who have or have had relationships with basketball players rather than the players themselves. Thus, the show appears to be transformative.? Arenas argued that BWLA used his identity solely to attract attention to the show because the show wasn?t related to him.? ?This is simply untrue. Unlike Vanna White and Samsung videocassette recorders or Bette Midler and Ford cars, there is an obvious connection between Arenas and BWLA.? Shed Media's show is about women who have dated or married basketball players. Arenas is a basketball player who dated one of BWLA?s cast members. While the show is not predominantly about Arenas, it is not so unconnected to him as to vitiate Shed Media's First Amendment defense.?? In a footnote, the court pointed out that, even if the show were predominantly about Arenas, it would still be protected by the First Amendment, as unauthorized biographies are.? Importantly, the court?s reasoning was not that this hypothetical show would be transformative?see the Saderup quote above?but rather that a contrary result would chill lots of expression.? But of course this is why Saderup is (at least on its own) a terrible rule.? It sets up inherent conflicts with the other popular First Amendment test, Rogers v. Grimaldi: a Saderup-transformative use of a celebrity may seem to lack artistic relevance (Rosa Parks), while an accurate portrayal, which is artistically relevant by definition once you?ve chosen to depict a particular celebrity, seems nontransformative (Saderup).? But we?re ok with chilling the expression of visual artists. On to the public interest defense: the public has a right to know things!? This includes reporting on recent events, even ones in the entertainment field, and people legitimately in the public eye.? Arenas argued that discussion of his family life wasn?t sufficiently related to his celebrity to render BWLA?s use of his identity a matter of public concern.? Best use of Twitter I?ve seen in a legal opinion yet: ?This contention is belied by the tens of thousands of Twitter users who follow Arenas as he tweets about a variety of mundane occurrences. (See, e.g., ?dont u hate waking up doing the same thing..wash face.. brush teeth..pee..take shower(well sum of us) ... put on clothes ... eat ... etc?).?? He?s a celebrity and thus the public has an interest in him. Arenas then argued that there could be no First Amendment defense because Shed Media acted with actual malice.? This picks up on a problem I had with Stewart v. Rolling Stone, which was that the case imported the concept of actual malice into the right of publicity context with no coherent explanation of what exactly had to be malicious?the best candidate seemed to be the commercial use.? But if that?s so, Shed Media would almost certainly have acted with malice according to what the court said above, since it obviously knew it was going to evoke Arenas?s identity and wanted to make money, which apparently counts as ?commercial.?? But since the public interest defense contemplates that for-profit publishers can report on celebrities because of the beneficial effects for public discourse, it can?t be ?malicious? to do so deliberately.? In the absence of any coherent explanation of what one must be actually malicious about, the court here closed the circle: delightfully, it applied the actual malice standard from NYT v. Sullivan.? Because Arenas alleged neither defamation nor even falsehood, there was no way that defendants could have acted with knowledge of falsity or reckless disregard for the truth. Arenas?s counsel said he?d be satisfied with an injunction against using his name in promotional materials, but the court was having none of that.? If you can constitutionally make a show about someone, you can tell your potential audience what it?s about.? As long as it doesn?t falsely claim that Arenas endorses BWLA, the advertising is also safe. Notice that all this pain could have been avoided by a simple, and I believe constitutionally compelled, rule: the right of publicity can only be violated by commercial speech.? ?Commercial? in California?s ?commercial appropriation? tort should mean the same thing it does in First Amendment law.? BWLA is not an ad and could not constitute commercial appropriation.? There, I fixed it. Turning to trademark, the court described Arenas?s infringement claim as ?muddled,? lacking a theory of infringement.? He claimed trademarks in his name and variants thereof, and then added that the very presence of Govan and the show?s title was an obvious reference to him and a use of his likeness.? He further alleged that defendants were going to use his marks in commerce in connection with advertising BWLA.? But ?Basketball Wives? and ?Gilbert Arenas? (etc.) are not likely to be confused under the standard multifactor test.? Arenas argued that the court should instead use the variant multifactor test of Downing for his false endorsement claim, but the court declined because defendants weren?t using Arenas?s ?likeness,? in the sense of his ?image?either actual or suggested.?? I have no idea what this means.? Is ?image? metaphorical?? I would have thought that Downing applies to the use of a name without a picture. And would this argument disappear if BWLA shows him in a picture taken by Govan and displayed by her? This strange statement is just another manifestation of the fact that trademark law has metastized without figuring out how to make sense of its defenses: Arenas shouldn?t have a false endorsement claim based on a TV show whose characters talk about him, but somehow the case law doesn?t make clear why that is so. Arenas also argued infringement based on use of his name.? That?s nominative fair use.? Defendants have to use his name to talk about him.? Given the prospective nature of the claims, the court couldn?t predict whether they?d eventually ?use more of his marks than necessary,? whatever that could possibly mean (after Mattel v. MCA, I would suggest it places no particular limit on what an expressive production like a song or TV show can do).? ?[M]ost importantly, allowing Govan to talk about her relationship with Arenas on BWLA and permitting Shed Media to advertise that its show will feature such discussions in no way suggests that Arenas endorses the show. To the contrary, common sense suggests that a celebrity may not agree with his ex-girlfriend's opinion of him.? Arenas argued that he?d suffer irreparable harm without an injunction because of harm to his reputation, given that the Basketball Wives franchise ?prides itself on its coarse brand of drama,? featuring ?cat fights? and ?infidelity issues.? ?Though there are obvious First Amendment problems with counting this as harm, the court instead hit Arenas in the ego: ?Shed Media provides a treasure trove of newspaper articles about and tweets by Arenas that, taken as a whole, convince the Court that Plaintiff's reputation will suffer no serious blow if BWLA airs as scheduled.? [I]t is difficult to see how an association with ?cat fights? will tarnish Arenas' reputation when he has been publicly associated with potential gunfights?. Arenas has publicized on Twitter his views of women and other groups?opinions that would be characterized by many, if not most, people as crude and offensive.?? (So if he?d been known as a model citizen without a Twitter account, would the court have accepted that he could suffer irreparable harm from a show that, on this record, was neither defamatory nor even wrong about him? ?The next Tiger Woods might like an answer.)? Further, Arenas already associated himself with the show ?by tweeting directly or indirectly about Govan?s appearance on it?. Arenas? own tweets calling attention to Govan's upcoming appearance on BWLA undermine his claim that he will be injured by an association with the show.?? True, even a man with a bad reputation may be libeled, but that doesn?t go to irreparable injury. The balance of equities also tipped sharply in Shed Media?s favor, given the potential harm to timely broadcast.? And there was a significant public interest in protecting First Amendment rights. All this meant that Shed Media prevailed on its anti-SLAPP motion, since its conduct was in furtherance of its free speech rights in connection with a matter of public concern. Arenas v. Shed Media U.S. Inc., No. 2:11-cv-05279-DMG -PJW (C.D. Cal. June 6, 2012) Shed Media moved for the attorneys? fees to which it was entitled based on its successful anti-SLAPP motion.? Arenas argued that Shed Media wasn?t a prevailing defendant because the court dismissed the complaint with leave to amend.? The potential for amendment wasn?t enough to take Shed Media out of ?prevailing defendant? status.? Its victory was on the merits, even though the court was not completely certain that Arenas couldn?t state a claim with additional allegations; the court?s ruling ?greatly reduced the potential scope of any amended claim,? and indeed Arenas ultimately chose not to file an amended complaint.? Shed Media was awarded a bit over $32,000 in attorneys? fees.? Arenas was, however, allowed to dismiss his claims without prejudice.

How to avoid traps in plastic electronics

Plastic electronics hold the promise of cheap, mass-produced devices. But plastic semiconductors have an important flaw: the electronic current is influenced by "charge traps" in the material. These traps, which have a negative impact on plastic light-emitting diodes and solar cells, are poorly understood.

However, a new study by a team of researchers from the University of Groningen and the Georgia Institute of Technology reveals a common mechanism underlying these traps and provides a theoretical framework to design trap-free plastic electronics. The results are presented in an advance online publication of the journal Nature Materials.

Plastic semiconductors are made from organic, carbon-based polymers, comprising a tunable forbidden energy gap. In a plastic light-emitting diode (LED), an electron current is injected into a higher molecular orbital, situated just above the energy gap. After injection, the electrons move toward the middle of the LED and fall down in energy across the forbidden energy gap, converting the energy loss into photons. As a result, an electrical current is converted into visible light.

However, during their passage through the semiconductor, a lot of electrons get stuck in traps in the material and can no longer be converted into light. In addition, this trapping process greatly reduces the electron current and moves the location where electrons are converted into photons away from the center of the device.

"This reduces the amount of light the diode can produce," explained Herman Nicolai, first author of the Nature Materials paper.

The traps are poorly understood, and it has been suggested that they are caused by kinks in the polymer chains or impurities in the material.

"We've set out to solve this puzzle by comparing the properties of these traps in nine different polymers," Nicolai explained. "The comparison revealed that the traps in all materials had a very similar energy level."

The Georgia Tech group, led by Jean-Luc Bredas, investigated computationally the electronic structure of a wide range of possible traps. "What we found out from the calculations is that the energy level of the traps measured experimentally matches that produced by a water-oxygen complex," said Bredas.

Nicolai explains that "such a complex could easily be introduced during the manufacturing of the semiconductor material, even if this is done under controlled conditions." The devices Nicolai studied were fabricated in a nitrogen atmosphere, "but this cannot prevent contamination with minute quantities of oxygen and water," he noted.

The fact that the traps have a similar energy level means that it is now possible to estimate the expected electron current in different plastic materials. And it also points the way to trap-free materials. "The trap energy lies in the forbidden energy gap," Nicolai explained.

This energy gap represents the difference in energy of the outer shell in which the electrons circle in their ground state and the higher orbital to which they can be moved to become mobile charge carriers. When such a mobile electron runs into a trap that is within the energy gap it will fall in, because the trap has a lower energy level.

"But if chemists could design semiconducting polymers in which the trap energy is above that of the higher orbital in which the electrons move through the material, they couldn't fall in," he suggested. "In this case, the energy level of the trap would be higher than that of the electron."

The results of this study are therefore important for both plastic LEDs and plastic solar cells. "In both cases, the electron current should not be hindered by charge trapping. With our results, more efficient designs can be made," Nicolai concluded.

Twitter suspends reporter's account for NBC tweet

SAN FRANCISCO (Reuters) - Twitter Inc and NBC Universal's move to suppress a British reporter's tweets related to the network's Olympics coverage may have backfired after the incident became fodder for Twitter chatter around the world on Monday.

The microblogging service suspended Guy Adams, the Los Angeles correspondent for London-based daily The Independent, after he sent a tweet on Friday revealing NBC Olympics President Gary Zenkel's email address.

Adams was among a number of Twitter users in the United States who vented their frustration with NBC, a Comcast Corp subsidiary, for showing the London Olympics' opening ceremony on tape delay to coincide with evening prime-time in the United States.

"The man responsible for NBC pretending the Olympics haven't started yet is Gary Zenkel. Tell him what u think! Email: Gary.zenkel@nbcuni.com," Adams tweeted.

As part of his suspension, Adams' account and his tweets were rendered invisible. But in a twist of irony, the incident went viral on Monday, as "Guy Adams" became a worldwide trending topic on Twitter.

In an email to Adams, Twitter informed the reporter that he had violated "Twitter Rules" by posting another user's private information such as "private email address, physical address, telephone number, or financial documents."

NBC confirmed that it had filed a complaint with Twitter.

"A user tweeted the personal information of one of our executives," NBC Sports said. "According to Twitter, this is a violation of their privacy policy. Twitter alone levies discipline."

Adams, who estimated that he has about 4,500 Twitter followers, had been one of the more vocal critics of NBC's coverage. The Monday issue of The Independent carried an article by Adams that was broadly critical of NBC's Olympics coverage, including its commentary of the opening ceremonies, but made no mention of the Twitter incident.

"It's obviously somewhat sinister for a Twitter account to be shut down at the behest of an Olympic sponsor," Adams told Reuters on Monday.

Twitter, which entered into a strategic, non-financial partnership with NBC to curate online content during the Olympics, declined to comment.

Latest Tea Party Vs. GOP Establishment Battle Comes Tuesday In Texas

One question heard over and over again this year: Is the Tea Party still relevant?

The question comes two years after it completely dominated the political conversation in 2010, when it was primarily responsible for defeating the Republican establishment in key Senate races such as in Florida (Marco Rubio over Charlie Crist), Kentucky (Rand Paul over Trey Grayson) and Utah (Mike Lee over Robert Bennett). In Pennsylvania, the Tea Party helped Pat Toomey end the GOP career (and Senate career) of Arlen Specter. In Wisconsin, it backed an unknown businessman, Ron Johnson, in his improbable victory over Russ Feingold. And it contributed scores of candidates, money and manpower in the Republicans' whopping net gain of 63 seats in the House.

There were some defeats, to be sure. They were blamed for throwing away all-but-certain Senate wins in Nevada, Colorado and Delaware, backing candidates (Sharron Angle, Ken Buck and Christine O'Donnell respectively) who won in the primary but fell far short of attracting enough Democratic and independent crossovers to win in November.

But when all was said and done, the Tea Party was instrumental in the big Republican victories of 2010.

This year, the scorecard is less clear-cut. They didn't come up with a winning Republican alternative to Mitt Romney, despite an endless tryout of wannabes. They did knock off six-term GOP Senate incumbent Dick Lugar in Indiana, but they failed to do the same to Orrin Hatch in Utah. (They will argue, with some justification, that their challenge to Hatch made him a much more reliable conservative.) And while they are pleased with the primary victory of state Sen. Deb Fischer in Nebraska, there were Tea Party activists who were behind the two losing GOP candidates, Jon Bruning and Don Stenberg.

One race that has clearly excited Tea Party activists is tomorrow's (Tuesday July 31) GOP primary runoff in Texas for the Senate seat of retiring Republican Kay Bailey Hutchison. Their candidate is Ted Cruz, the state's former solicitor general, who is being vastly outspent by his "establishment" opponent, Lt. Gov. David Dewhurst, who led Cruz by ten percentage points in the initial primary back in May.

Dewhurst is hardly a RINO; he is a longtime conservative who boasts the strong backing of Gov. Rick Perry and many leaders in the Lone Star State's GOP ranks. But the TP'ers insist Dewhurst, as president of the state Senate, is too eager to compromise with Democrats. He is also 66 years old, a quarter-century older than Cruz, and has spent nearly a decade in his current position ? hardly the 36 years both Lugar and Hatch have been in the Senate, but hardly the new face that Cruz represents.

Cruz, who has been compared favorably to Rubio ? both have parents who were born in Cuba ? is a dynamic debater who excites crowds wherever he goes. If Dewhurst has been getting the backing of a who's-who in Texas GOP circles, Cruz has been endorsed by a slew of national conservative figures, including Sarah Palin, Rick Santorum, Jim DeMint, Rand Paul, Sean Hannity and the Club for Growth. To paraphrase George Wallace, there may not be a dime's worth of difference between the two of them. But it's become the latest test of the Tea Party and its ability to take down members of the Republican establishment.

For the record, Democrats are also holding a runoff on the 31st, between ex-state Rep. Paul Sadler and retired educator Grady Yarbrough. But no Democrat has won a statewide race in Texas since 1994, and their last Senate winner came in 1988, when Lloyd Bentsen won his fourth and final term.

Still to come: the Aug. 7 Senate GOP primary in Missouri, where the Tea Party Express has endorsed former state Treasurer Sarah Steelman, and the Republican primary a week later in Wisconsin, where if nothing else the Tea Party wants to defeat frontrunner Tommy Thompson, a former governor.

Senate Ratings Update. Here is an update from my last "Battle for the Senate" ratings from back in January. Of the 33 Senate seats up for grabs, 23 are currently held by Democrats or Democratic-leaning independents. Only ten are held by Republicans. With Democrats currently holding a 53-47 advantage, the GOP would need four seats to take control ? or three, if they win the White House (and the VP would break a 50-50 tie).

The big change since my January ratings is in Maine. Back then, with the expectation that Olympia Snowe (R) would run again, I rated it "Republican Favored." With her retirement and the likelihood that former Gov. Angus King, an independent, will win, I'm moving it to "Expected GOP Loss." The further expectation is that King, should he be elected, will caucus with the Democrats.

Also, I've moved North Dakota, where Kent Conrad (D) is retiring, from "Expected Dem Loss" to "Tossup." And I've moved Florida, where Bill Nelson (D) is seeking re-election, from "Tossup" to "Democrat Favored."

A: I'm with you. As I wrote last week, I wanted to like it because (1) I too am a Sigourney Weaver fan, and (2) the topic ? a defeated female presidential candidate-turned-secretary of state ? looked like a promising theme for a TV series. But you're right. "Bud Hammond," the former president and caricature of Bill Clinton is done so clumsily, with lines written so painfully that, for me, it's nearly impossible to watch. Ciaran Hinds, the actor from Northern Ireland, may have some talent, but portraying Bud/Bill from North Carolina ain't one of them. No third episode for me.

Not that anyone asked me, but after five episodes of "The Newsroom," the HBO series starring Jeff Daniels about a cable news program and its suddenly opinionated anchor, I'm still trying to make up my mind. When the story line is about relationships between people inside and outside the network, or about the pressure of covering breaking news, it's fabulous. But I gotta tell you, it's getting a bit much being lectured by Aaron Sorkin time and time again about the Tea Party, Michele Bachmann, the Koch Brothers, etc. etc. etc. Yes, I get it, they're the bad guys. Fine. And I know exactly what Sorkin is trying to do by having the Daniels character be a registered Republican. (Hey, it's not liberal Aaron Sorkin bashing the right, it's a Republican!) Asking a Sorkin program not to be preachy may be asking for too much. But when it focuses on human drama, it's top notch.

Obama and Insurers Join to Cut Health Care Fraud | Health and ...

The collaboration represents something of a turnabout for Mr. Obama, who in the last three years has often denounced ?abuses by the insurance industry.? The White House is now enlisting some of the same companies to help ferret out fraud.

Kathleen Sebelius, the health and human services secretary, and Attorney General Eric H. Holder Jr. are scheduled to join insurers to unveil the initiative at the White House on Thursday.

?This partnership brings together the resources and best practices of government and private sectors, giving us an unprecedented ability to detect and stamp out health care fraud,? Ms. Sebelius said.

The charter for the venture says that federal investigators and insurers will pool claims data and look for suspicious billing patterns and aberrations. If agents detect possible fraud and begin an investigation, they can provide insurers with the names of doctors, hospitals and suppliers suspected of misconduct.

The claims data will come from Medicare, Medicaid and private insurance.

?The more claims data we have, the more effective we can be in analyzing and using it,? said an administration official working on the project.

For example, the official said, the new venture could identify a doctor who bills Medicare and two private insurers for a total of more than 24 hours of work in a single day.

?Seen separately,? the official said, ?these billings could appear normal. Sharing information among payers brings this potentially fraudulent activity to light so it can be stopped.?

Among the organizations expected to join the new National Fraud Prevention Partnership are two lobbies for the industry, America?s Health Insurance Plans and the Blue Cross and Blue Shield Association, as well as big insurers like Amerigroup, Humana, UnitedHealth and WellPoint.

Top officials from the Federal Bureau of Investigation will participate.

Lewis Morris, former chief counsel to the inspector general at the Department of Health and Human Services, said such collaboration made sense.

?Most of the criminals who prey on the nation?s health care system are equal opportunity thieves,? Mr. Morris said. ?They defraud private health insurance as well as federal programs like Medicare and Medicaid.?

However, Mr. Morris said, ?there could be significant challenges in building the level of trust needed to make this partnership truly effective.?

In the last decade, insurers have paid hundreds of millions of dollars to settle federal and state charges that they bilked public programs in various ways.

Under the agreement, the federal government and insurers will share information about trends in health care fraud and the tools they use to detect it in mountains of claims data.

The federal government will hire a ?trusted third party? to analyze the data collected from Medicare, Medicaid and dozens of private health plans.

Karen M. Ignagni, president of America?s Health Insurance Plans, described the information-sharing project as ?a major national initiative to detect and prevent fraud.? Such cooperation has worked well when tried at the local level in selected cases, Ms. Ignagni said.

Several United States attorneys have worked with private insurers in specific cases. The United States attorney in Kansas, for example, cooperated with insurers in investigating a pain clinic that distributed narcotics to patients, including several dozen who died of drug overdoses.

Medicare receives more than a billion claims a year from doctors, hospitals, pharmacies, suppliers of medical equipment and other providers. Increasingly, the government uses ?data mining? techniques to identify providers and claims that pose the greatest risk of fraud. Medicare officials discovered, for example, that they were spending far more per beneficiary for asthma drugs in South Florida than in the rest of the country.

Fluoxetine -- a.k.a., Prozac -- is effective as an anti-viral, study suggests

ScienceDaily (July 27, 2012) ? UCLA researchers have come across an unexpected potential use for fluoxetine -- commonly known as Prozac -- which shows promise as an antiviral agent. The discovery could provide another tool in treating human enteroviruses that sicken and kill people in the U.S. and around the world.

Human enteroviruses are members of a genus containing more than 100 distinct RNA viruses responsible for various life threatening infections, such as poliomyelitis and encephalitis. While immunization has all but eliminated the poliovirus, the archetype for the genus, no antiviral drugs currently exist for the treatment of enterovirus infections, which are often severe and potentially fatal. In view of its favorable pharmacokinetics and safety profile of fluoxetine -- which is in a class of compounds typically used in the treatment of depression, anxiety disorders and some personality disorders -- the research team found that it warrants additional study as a potential antiviral agent for enterovirus infections.

Using molecular screening, the UCLA research team from the Department of Pediatrics, the California NanoSystems Institute and the Department of Molecular and Medical Pharmacology found that fluoxetine was a potent inhibitor of coxsackievirus replication. This is one of the viruses that include polio and echovirus that is found in the gastrointestinal tract. Exposure to the virus causes other opportunistic infections and diseases.

"The discovery of unexpected antiviral activity of fluoxetine is scientifically very significant and draws our attention to previously overlooked potential targets of fluoxetine and other psychogenic drugs," said Robert Damoiseaux, scientific director of the Molecular Screening Shared Resource at the California NanoSystems Institute. "Part of our follow-up work will be the discovery of these unconventional targets for fluoxetine and other drugs of the same class and how these targets intersect with the known targets of this drug class."

Paul Krogstad, professor of pediatrics and molecular and medical pharmacology, added that understanding the mechanisms of action of fluoxetine and norfloxetine against coxsackieviruses "will add to our understanding of enterovirus replication and lead to assessment of their potential clinical utility for the future treatment of serious enterovirus infections."

The research team found that fluoxetine did not interfere with either viral entry or translation of the viral genome. Instead, fluoxetine and norfluoxetine markedly reduced the production of viral RNA and protein.

The study was published on July 2 in the journal of Antimicrobial Agents and Chemotherapy. Study authors also include Jun Zuo, Kevin K. Quinn, Steve Kye, and Paige Cooper from the Department of Pediatrics. The study was supported by grants from the Today's and Tomorrow's Children's Fund and the UCLA Department of Pediatrics Nanopediatrics Program.

This thread is a compilation of the races, factions, and locations important to Kirkwall, and to the RP, and will hopefully serve as somewhat of a beginner?s guide to Dragon Age lore for those not very familiar. I will add to it by request. Most of this information comes from the Dragon Age Wiki, and of course if you?re curious about anything, the wiki will have the information you need, as well as probably a whole lot more you won?t care about. These tidbits I?m providing are just to get a general sense of the important things to Kirkwall. I highly recommending reading the respective wiki entries of whatever group you are planning on creating a character of, if you aren?t already familiar with the lore.

Here is a map of Thedas, for those who are curious, though the RP will be taking place exclusively in and around Kirkwall. Still, it helps to know where everything is.





Humans

The most numerous of the races in Thedas, but also the most divided. Rarely have the humans united under a single banner, and the last it happened was centuries ago. Humans have created drastically different societies across the world, powerful nations such as Ferelden, Orlais, and the Tevinter Imperium. They are also responsible for the creation of the Chantry, the most common religion in human society. They are the most versatile of the races, and will typically adapt to any given situation if given enough time. The greatest threat to human dominance in Thedas is their lack of unity. Centuries old hatreds divide some nations, and it would take a truly massive threat to get them all to cooperate.

There is also great difference among the classes of humans. The nobility often live in great luxury, while the unfortunate poor are looked down upon and left to fight amongst themselves for survival. In Kirkwall, this problem is particularly acute, and has even led to violence in the past.




Elves

The elves of Thedas are typically slightly shorter than humans, and have more slender, lithe builds. Their life spans are no longer than that of humans, though it is speculated that this was not always the case. They believe they were once an immortal and immensely magically talented race that lived in harmony with the natural world, but that the arrival of humans ?quickened? them, causing them to begin aging and dying. Humans were also responsible for the eventual destruction of their empire, so it?s no surprise the two races don?t often get along well.

Most elves in the present live as second class citizens in human cities, and racism between humans and elves is a common occurrence, in both directions. They are typically confined to alienages in the poorer districts of a city, where they try to keep some small amount of their culture alive. Some elves, however, refuse to submit to any human rule, and wander the wild in clans known as the Dalish, who dedicate themselves to preserving their culture, and not allowing it to be destroyed by the humans. Though it may no longer be possible, the elves wish for a return to their former splendor, before all of their culture is lost to the ages.




Dwarves

The dwarves, like the elves, were once a far greater people than they are currently, though the cause of their downfall has been the darkspawn, not the humans. The large majority of these short, powerful, hardy folk dwell in underground cities carved from the stone. The darkspawn also originating from underground, it was no surprise that the Dwarven kingdoms were the first to suffer from their arrival. All but one of their cities have fallen, the last being Orzammar, underneath the Frostback Mountains in Ferelden.

Several major differences separate dwarves from the other races. They do not enter the Fade, the realm of spirits and demons, as elves and humans do, when they dream, and thus they lack magical talent utterly, although they gain a resistance to all magical forms, and lyrium exposure, in return. They place a large emphasis upon strength and martial prowess instead. Their religion, too, is different. They do not worship the Maker as the humans do, but rather the Stone from which they were born, as well as Paragons of their society, individuals who distinguish themselves in their lifetimes enough to become essentially living gods.




Qunari

The Qunari, for the most part, are a mystery to the races of the mainland. They hail from an unknown eastern land across the Northern Ocean, a land which they since lost contact with more than a century ago. Their territory in the known world consists of the islands Par Vollen and Seheron, in the north, although their armies once threatened to conquer the entirety of the known world, and were one of the few things that could unite humans together. They currently have a firm grip on Par Vollen, and battle with the Tevinter Imperium for control of Seheron, a war which has lasted over eighty years.

The word ?Qunari? does not actually refer to the horned species that one thinks of, but rather any being who adheres to the teachings of the Qun, the strict religion which the Qunari follow, meaning that elves, humans, and dwarves could become Qunari if they wished. The horned people are actually called kossith, though they are almost always referred to as Qunari. Few understand their duty-centric beliefs, and the vast majority of people simply fear them for their ways, which seem brutal and unforgiving by human standards.







The Chantry

The Chantry is the dominant religious organization across Thedas, the philosophy of which is based upon the life and teachings of the prophetess Andraste. The teachings were written in the form of the Chant of Light, and are supposedly the words of the Maker, the holy being which has since abandoned mankind for their transgression, specifically those of the first magisters in the old Tevinter Imperium, who sought to use blood magic to enter the Maker?s golden city, but instead ended up destroying it. The faithful believe if the Chant can be spread to the four corners of the world, that the Maker will hear it, and return to His children.

In practice, the Chantry holds a great deal of power in all human lands save for the Tevinter Imperium, where the Magisters still effectively rule. The entirely female priesthood of the Chantry is headed by the Divine, who leads from the Grand Cathedral in Val Royeaux, in Orlais. But the Chant has indeed spread far. In Kirkwall, the Chantry is prominent enough to have a Grand Cleric, and the opinions of her and her fellow sisters and mothers are highly respected throughout the city.




The Templar Order

The Templars are a military order of the Chantry with the primary duty of watching over the mages within the various Circles of Magi throughout Thedas, as well as hunting down mages living outside of the Circle, known as apostates, specifically those that resort to blood magic, known as maleficarum. Officially, they are a force for defense, established to protect the faithful from threats of magical origin. In truth however, they are an army; well-equipped, extremely disciplined through training, and highly devoted to the Maker. They are specifically trained to combat mages, and possess abilities to both shield themselves from magic, and nullify a mage?s ability to cast spells in the first place.

Those that believe the Viscount is the one ruling Kirkwall are fools; the real power rests with the Templar Order in the city, and their driven Knight-Commander. The Order has a very strong presence within the city, strong enough to the point where the Viscount is forced to listen to the Knight-Commander?s counsel, especially in matters relating to the local Circle of Magi. Very little happens in Kirkwall without the Templar Order?s knowledge.




The Circle of Magi

There are some things one must understand about magic in Thedas to understand why the mages are treated as they are. Magic originates from the Fade, the realm of spirits and demons, the place where people dream. Malevolent spirits, the demons, wish little more than to experience mortality, and incessantly try to possess mages. Use of magic can draw the attention of demons on the other side of the Veil, and increase the risk of demonic possession. A mage who becomes possessed by a demon becomes an abomination, an immensely powerful creature of nightmare. It is for this reason that the Templar Order watches over mages, confines them into easily defended areas. Mages are dangerous, whether they intend to be or not. It is often a mage with the best intentions that causes the most damage.

And of course, some mages do not have good intentions. Some willingly make dealings with demons, acquiring the knowledge they possess often in exchange for something the demon wants, which rarely is beneficial for others. Demons alone fully understand the intricacies of blood magic, the forbidden school which is feared above all others for its incredible potential for power through dark rituals. Put all this together, and it?s no wonder the mages are oppressed in the current age.

The Circle was established by the Chantry, and it is enforced by the Templars. Children that show magical potential are taken by the Circle usually between 6 and 12 years of age, regardless of their social status. They are trained under by older mages, and watched closely by the Templars, until they are young adults, at which point they undergo a trial called the Harrowing, meant to prove that they are capable of defending themselves against the lure of demons. Should they fail, the Templars kill them on the spot. Even after passing, mages are confined to their Circles unless given explicit permission by the Templars that they may leave for some purpose, in which case the Templars will still follow them, to ensure nothing goes wrong.

It is undoubtedly a harsh system, but the dangers mages have posed upon the world in the past seem to indicate that it is necessary. How far the Templars should be allowed to go, however, remains up for debate.




Dalish Elves

All the lands of Thedas are ruled by humans, and so the Dalish, a people who wish to live under no rule but their own, are generally not welcome in most places. They are an extremely proud people. Their clans date back to the time when elves once had an empire, and as such, they believe they have the purest blood of all elvenkind. They are also extremely distrusting of outsiders, particularly shemlen, the humans, although they are also known to not even really respect their city dwelling cousins, those who have given up the old ways to live under the heels of humans. They are peerless hunters, and each clan has a pair of mages, the Keeper, who leads the clan, and the Keeper?s First, an apprentice who will lead the clan when the current Keeper passes on.

Members of the nomadic Dalish clans are marked with vallaslin, or blood writing, in intricate facial tattoos upon reaching adulthood, with different designs representing the different gods in the Elven Pantheon. A Dalish elf within the city would not be mistaken for just another city dweller by the elves within, and would likely be treated with respect, if not reverence. They represent the greatness that was once the elven race.




Surface Dwarves

While they aren?t necessarily a faction, there are certain differences that surface dwarves typically have from those that remain in the underground city of Orzammar. Living upon the surface is a fate that many dwarves fear; the very sky seems a danger. And with their reverence of the Stone, dwarves who voluntarily leave the city to live upon the surface are largely looked down upon. Should they attempt to return to the city, they would likely be casteless, and not have a place in dwarven society any longer.

It is typically dwarves from the lower castes that end up on the surface, as leaving Orzammar can be an escape from the caste system that holds them down. On the surface, they can make their own fortunes, both for themselves, and for their children. The lower caste background also means they are more likely to be criminals, considering that often the only profession available for casteless dwarves involves crime.

Some of them don?t even have beards.



General descriptions of the locations in and around Kirkwall. These are the locations your characters can travel to during the RP.





Hightown

Everyone who is anyone in Kirkwall lives in Hightown. In their bird?s nest overlooking the rest of the city, the people of Hightown have little to complain about other than the occasional stench that wafts up from Lowtown. The people here feel safe, if only because an invader would have to scale the many steps upon the stairs up to Hightown. In several wars, Hightown has held out for months after Lowtown was more or less destroyed. It is the only wealthy district of the city, and those who live in Hightown are the envy of all in Kirkwall.

Notable Places in Hightown
The Viscount?s Keep: The center of power in Kirkwall, symbolically. It towers above the other manors in Hightown, and is only rivaled by the Chantry in terms of splendor. Home to the Viscount and his family, as well as the guard barracks.
The Chantry: The home of the Grand Cleric, a towering structure that dwarfs the other mansions. It is as much a symbol of the Chantry?s powerful hold over Kirkwall as it is a place of worship.
The Blooming Rose: A luxurious brothel in Hightown?s Red Lantern District. They provide "the royal treatment" for 2 sovereigns, "standard services" for 1 sovereign and for 50 silver "someone may briefly touch you for an hour."




Lowtown

Lowtown is literally a pit where slaves once lived, back in the days when Kirkwall was a frontier city for the Tevinter Imperium. Here the city?s common folk carved a living out of the rock face, while their overlords rested in luxury at the top of the city?s narrow stairs. In the present, it is the most colorful and lively part of Kirkwall, though certainly not the safest. It?s a melting pot of human, dwarven, and elven residents, none of which have much coin to speak of. A newcomer would find Lowtown a vast maze, filled with shantytowns and unorganized corridors, clustered around markets and stalls.

Notable Places in Lowtown
The Elven Alienage: The elves of Kirkwall live in a rather secluded corner of Lowtown, around the vhenadahl, the massive tree that all alienages have. It?s possibly the only greenery in the district. Though the elves are poor, there are worse places to be in Kirkwall.
The Hanged Man: One of the more popular destinations in Kirkwall, despite its seedy reputation. It?s a tavern where the ale tastes like piss and the stew has meat of unknown origin, but many people, both travelers and locals, will pass through it, and share their stories among questionably good company.




Darktown

Those in Lowtown can take comfort in the knowledge that as bad as they have it, others have it worse. Darktown is a den of inequity, a place where only the most pitiful of people dwell. It?s built in the underground and sewers of the city, and is typically polluted, the streets covered in a kind of toxic fog, making it no surprise that disease has become widespread throughout the district. It is a hive of crime, and numerous criminal bases, such as the dwarven Carta, make their home here. Even the Templars tend to keep their distance from Darktown, viewing the place as simply a lost cause. If someone needed a place to hide, Darktown would be their best bet. The arrival of the Blight refugees from Ferelden only made the problems of the district worse, as many of them were forced into Darktown, having no other place to go.




The Docks

Kirkwall?s docks are located across a small channel from the towering Gallows, at the base of Lowtown, just outside of the city?s massive walls. Like Lowtown, it was carved out of the quarry rock by slaves from the time when Kirkwall belonged to the Imperium. Currently, this is where the majority of the trade performed within the city is done, and anyone with a ship will be visiting this area frequently. Supposedly one must have a permit in order to dock in Kirkwall, but the city guard rarely enforces this.

Notable Place in the Docks
Qunari Compound: After the Arishok and his fleet were shipwrecked off the Wounded Coast, the Viscount ?gifted? them with a section of the docks for them to temporarily stay in, until a ship comes to take them home. The Qunari have since heavily fortified this compound, and it now appears more like a fort than a temporary home. The thick wooden gate they built opens only for those whom the Arishok has business with.




The Gallows

Anyone seeking entry to Kirkwall by sea must first pass through the Gallows, a towering castle on an island across a narrow channel from the Docks. This place was designed by the magisters of the Tevinter Imperium, meant to break the spirits of the slaves who once passed through on their way to the quarries. Statues of tortured slaves fill the courtyard, mementos of the city?s history. Its current use is to be the home of the Circle of Magi in Kirkwall, as well as the army of Templars that keep watch over them. The city guard also has a presence in the castle, operating and maintaining the city?s dungeons, underneath the surface.

Notable Locations in the Gallows
Templar Hall: The home of the Templars in Kirkwall. It is here that they are trained, housed, and supplied, and is the home of the Knight-Commander and her highest officers.
The Circle of Magi: On the opposite end of the castle, in considerably smaller quarters, are the mages of the Circle, and their First Enchanter. The Gallows could easily be seen as more of a prison than a home for them.




Sundermount

Kirkwall is guarded by the Vimmark Mountains to the north, the largest of which is also the nearest to the city. Sundermount has a dark reputation, with legends stating that it was the site of a vicious battle between the Tevinter Imperium and the elves of Arlathan. Great horrors were supposedly unleashed during the battle, and to this day unholy beings prowl the mountain?s heights.

Notable Places at Sundermount
Dalish Encampment: The Sabrae Clan of Dalish elves were forced to settle at the mountain?s foot after losing their herd of halla, the noble creatures that pull the elven landships which carry their kind. Their Keeper supposedly has business in the area as well.




The Wounded Coast

One of the roads that travel into Kirkwall, the Wounded Coast is typically avoided if possible, due to its reputation for housing bandits that hide among the rocky cliffs, as well as the predators that make their home in the area. There is little vegetation here apart from the occasional palm tree, and storms frequently lash the area. One such storm caused the Qunari fleet in the area to crash upon the rocks, killing many of their warriors, and leaving the rest stranded in the city.




The Bone Pit

Due to Kirkwall?s dark history, there are few places surrounding it that have good reputations. If you couldn?t tell from the name, the Bone Pit is not one of these places. It was once known as the Maharian Quarry, and was once of the mines controlled by the Tevinter Imperium. As always, the magisters used slave labor to work the mines, and the Bone Pit got its name from the high number of workers that died within the mines. Stories are told of one overseer who supposedly fed the occasional slave to his dragonling pets, presumably as punishment. Some believe the number of deaths actually weakened the Veil in the area, effectively cursing the mine. It is currently owned by an Orlesian Hightown merchant, who is employing mostly Ferelden refugees, the cheapest available labor.
